Mr. Marcus focuses his practice on complex commercial and employment litigation, as well as class and collective actions. He has represented plaintiffs and defendants in cases involving the Fair Credit Reporting Act, the Telephone Consumer Protection Act, the Racketeer Influenced and Corrupt Organizations Act, the Computer Fraud and Abuse Act, the Family Medical Leave Act, the Uniform Trade Secrets Act, the federal Anti-Kickback statute, and state consumer protection laws. He has handled securities arbitrations before the NASD (now FINRA) for both claimants and respondents. He has worked on several cases involving alleged accounting malpractice, most notably a case involving the failure of a large insurance company based in St. Louis.
Mr. Marcus attended Arizona State University in Tempe, Arizona. He graduated magna cum laude in 1993 with a bachelor's degree in political science. He then attended the University of Minnesota School of Law in Minneapolis, Minnesota. He graduated cum laude in 1996.
Mr. Marcus began his legal career with the Kansas City office of Shook, Hardy & Bacon, LLP, an international law firm known largely for its work in defending pharmaceutical manufacturers and tobacco companies against product liability lawsuits. He was part of the Pharmaceutical and Medical Device Practice Group, a position that gave him his first taste of large-scale, complex litigation and class actions.
In 1997, hoping to focus his practice on commercial litigation, Mr. Marcus joined the Kansas City office of Bryan Cave, LLP. There, he worked on commercial cases and class actions involving companies such as H&R Block and Kansas City Life Insurance Company.
In 1999, Mr. Marcus joined Berkowitz Oliver Williams Shaw & Eisenbrandt, LLP, a litigation boutique located on the Country Club Plaza. At Berkowitz, Mr. Marcus continued building his class action experience, representing clients such as American Family Mutual Insurance Company and Wal-Mart. He became a partner at Berkowitz in 2004.
In July 2005, driven by the desire to implement the valuable lessons he had learned about professionalism, client service, and meeting and exceeding client expectations, Mr. Marcus joined Matthew Bartle to form what would become Graves Bartle Marcus & Garrett, LLC. Graves Bartle Marcus & Garrett, LLC rejects the paint-by-numbers approach to resolving legal disputes, and instead emphasizes creativity, efficacy and efficiency. Mr. Marcus lives in Overland Park, Kansas with his wife, Elysia, and his daughter, Libby.
